TERMS & CONDITIONS OF SALE


PROPERTY:
(a)  The risk in the goods purchased shall, unless otherwise agreed in writing, pass to the buyer upon delivery to the Buyer or his Agent or a Carrier commissioned by the Buyer.

(b)  Property in each unit of the goods purchased shall pass to the Buyer when full payment has been received (each unit being considered as a whole) by the Seller, resale by the Buyer, consumption of the goods (otherwise than by repacking) by the Buyer or the mixing of the goods with other goods which ever occurs first.

(c)  Until property in the goods passes to the Buyer hereunder the Buyer shall unless otherwise agreed by the Seller store the goods so that they are clearly identified as property of the Seller.

PRICE CHANGES:  Prices are subject to alteration without notice and all materials will be charged at prices ruling at time of dispatch.

RETURNS:  goods will not be accepted by return for credit unless prior arrangements have been made with the Manger.

DELIVERY:  Prices quoted are excluding freight. Freight will be charged to the receiver’s account.

CLAIMS:  The Company accepts the responsibility of safe-guarding goods to the time of placing on the road, rail, sea or aid carrier. Claims for loss or damage of the goods in transit cannot be accepted by the Company and must be made on the carrier concerned.

DAMAGED SHIPMENT/SHORTAGES:  Any DAMAGED goods or SHORTAGES MUST be reported within 10 days of receipt of invoice. Claims made after 10 days will not be honoured. Shortages and damaged shipments due to carrier handling must be claimed to the carrier. Advise the driver and make a notation on the bill at the time of receipt.

PRODUCT OVERAGES/SHORTAGES:  If a product is missing or an extra product is included (but not ordered) please contact METRIC CRUISER CUSTOMS. All overages/shortages must be reported within 10 days of receiving goods.

REFUSED SHIPMENTS:  Freight charges incurred by any delivery refused and returned to METRIC CRUISER CUSTOMS will be the responsibility of the customer. Pre-payment will be required on any future orders until the settlement is complete. Upon the second refusal by the same customer, terms will permanently revert to pre-payment. Most returned orders result from a customer being unavailable to accept shipment or being unable to pay for the C.O.D. shipment.

LIMITED WARRANTY:  METRIC CRUISER CUSTOMS warrants its products against defects in material and workmanship for a period of 3 months. The warranty period begins with the date of the “original” retail purchase. It is the customer’s responsibility to establish the warranty period by verifying the original purchase date. Customers are responsible for packaging and shipping, including costs, when returning a product back to METRIC CRUISER CUSTOMS for inspection. Upon receipt, METRIC CRUISER CUSTOMS will evaluate the product or component in question. If a product is found to be defective by METRIC CRUISER CUSTOMS, it will be repaired or replaced and shipped back to the customer at no charge. The METRIC CRUISER CUSTOMS warranty does not cover loss of a use of vehicle on which a product is installed or any inconvenience that may occur at that time. METRIC CRUISER CUSTOMS does not cover damage to products due but not limited to the following damages: Damages from installation or removal, negligence, carelessness, accidents, misapplication, misuse, abuse or attempted unauthorized modification, harsh conditions, ordinary wear, power washing, natural occurrences such as stone chips, harsh cleaning agents or chemicals. METRIC CRUISER CUSTOMS is not responsible for short circuit or over-loaded current. Chrome quality should be inspected at the time of purchase. If the customer is not satisfied with the chrome quality at that time it is their responsibility to call for a return authorization. There are no express warranties that extend beyond those set forth in this document. METRIC CRUISER CUSTOMS will not accept returns unless goods are found to be faulty.

NOTE:  It is the responsibility of the purchaser to ensure the legality of the use of parts purchased on motorcycles in their particular State. Please check local laws before installing parts. Motorcycles can be dangerous if not ridden safely and properly maintained. METRIC CRUISER CUSTOMS has no control over the useage of any of its parts. METRIC CRUISER CUSTOMS expects customers to exercise good judgement. It is the sole responsibility of the purchaser to make themselves aware of any effect to warranty claims that the installation of non-OEM parts may have. METRIC CRUISER CUSTOMS takes no responsibility for any effect on warranty claims as a result of installation of non-OEM parts.

All matters shall be interpreted under Queensland law.

The customer aggress to this limited warranty by installing or having installed the METRIC CRUISER CUSTOMS product on their vehicle.
